CodeWizardsHQ Giveback/Fundraiser Terms and Conditions

  1. Eligibility and Participation
    1. Eligible Organizations: This giveback fundraiser program (“Program”) is open to PTAs, PTOs, and recognized student organizations (“Organization”) located in the United States and that have submitted all required information through the designated online form.
    2. Enrollment Tracking: Each Organization will be provided with a unique school code. To participate and receive credit for enrollments, the Organization must share this code with potential participants. Only those enrollments completed using the Organization’s unique school code will be counted toward the Organization’s giveback total.
    3. Compliance with Policies: By participating, the Organization confirms that it has the right to engage in fundraising and that it will comply with all applicable laws, school policies, and organizational guidelines.
  2. Calculation of Giveback Amount
    1. Basis for Calculation: The giveback amount is determined based on the number of valid introduction class enrollments using the Organization’s unique school code.
    2. Giveback Rate: Unless a separate agreement, signed by both parties and dated after the effective date of these terms and conditions, the Giveback Rate per each valid enrollment will be in the amount of $20.00. 
    3. Measurement Period: Enrollments are tallied at the end of each calendar month.
    4. Adjustments and Errors: We reserve the right to adjust enrollment counts for any fraudulent or duplicate enrollments, cancellations, or other similar issues. The Organization will be notified of any adjustments.
  3. Payment Terms
    1. Payment Schedule: After the monthly enrollment tally is finalized, the giveback amount will be calculated and prepared for payment.
    2. Payment Method: Payments will be made by check and mailed to the Organization’s name and mailing address provided in the registration form.
    3. Processing Time: Checks will typically be mailed within 30 days following the last day of the month in which enrollments are tallied. For example, giveback amounts for March enrollments are generally mailed by April 30.
    4. Lost or Returned Checks: If a check is lost, returned, or not received, the Organization must notify us promptly. We will make reasonable efforts to reissue or resend payment after verifying the situation.
  4. Obligations of the Organization
    1. Accurate Information: The Organization agrees to provide accurate and up-to-date information, including the correct mailing address and any required tax documents if applicable.
    2. Promotion: The Organization is responsible for promoting its unique school code and the Program in a lawful and ethical manner.
    3. Tax Responsibility: Any tax obligations related to the giveback amount are the sole responsibility of the Organization. We do not provide tax advice and recommend consulting a tax professional.
  5. Limitation of Liability
    1. No Guarantees: While we strive to maintain accurate tracking, we do not guarantee any minimum payment amount. The giveback amount depends solely on the number of valid enrollments recorded with the Organization’s code.
    2. No Indirect Damages: We are not responsible for any indirect, incidental, or consequential damages arising from participation in this Program.
    3. Privacy: CodeWizardsHQ will provide reasonable assistance to answer questions to Organization regarding their unique school code and usage. However, under no circumstances will we provide or release any personal identifiable information regarding the enrollments.
  6. Modification or Termination
    1. Changes to the Program: We reserve the right to modify, pause, or terminate this Program at any time. In such cases, we will provide reasonable notice to participating Organizations.
    2. Survival of Terms: If the Program ends, these terms and conditions continue to apply to any outstanding payments owed to the Organization.
  7. Acceptance of Terms
    1. Binding Agreement: By participating, the Organization acknowledges it has read and agrees to be bound by these Terms and Conditions.
    2. CodeWizardsHQ Agreement(s): By participating, the Organization acknowledges it has read and agrees to all other CodeWizardsHQ policies and terms including, but not limited to, CodeWizardsHQ Terms of Service and CodeWizardsHQ Privacy Policy.
